    I've started half fantasizing, half planning a better life outside the states. I think of everything in my life that could change for the better: more vacation, more travel, less of the neurotic american fear based mentality, more sun and summer, more time closer to my home country and relatives.

    I plan to stay here for the long haul, since I've been with my american life partner for 8 years (no GC for gay couples, though!), own property here, etc. But it helps with alleviating feelings of depression to remind myself that I actually do have options in life, and that I am not just a victim of an unfair immigration system.

    I read it the same way as you. The only difference I see here from provisions in CIR is that this seems to make a distinction between advanced degree holders from US vs outside. Looks like advanced degree holders from US do not have the 3 year restriction. This also seems to be consistent with section 203 where the employer would be allowed to start the GC process for US educated students while they are in OPT stage itself.

    Hi,

    Can someone explain the process of using AC21 for self employment? I have searched the web without much luck. If someone can throw some light on this topic along with how to deal with issues that come up with AC21 and self employment I would really appreciate it.

    best talk to a lawyer. It is worth the money in this case. These are arcane areas of the law, and once you make a mistake, you will be harassed all your life here.

    Why fight among EB2 and EB3? EB1 should be also a part of this, that's what we are good at...right?

    Is it fair that a EB1 from 2010 has a GC wheras an EB2 from 2005 is still waiting?

    There is no reason people who are here from 1999, and still does not have a GC, for a person who is EB2- 2006 why USCIS give priority? Let EB2 and Eb3 category move hand in hand they already gave some relief to EB2, now they should move EB-3, people are waiting whose priroty dates are Year 2002, but if a EB-2 just came on 2007 gets Green Card that is unfair, One year gap is ok between Eb-2 & EB-3 but not 5 years.

    I personally believe there are limitations for IV or any other organisation to influence the Political and Economic force that are existing in this world nowadays. Even if we lobby even if we talk, even if we gather, if those kind of forces are not benefitted in the form of votes(for power)(lobbying economically also depends on the personality of that person who you want to influence) nothing solid is going to happen. That is the TRUTH. But TRUTH sometimes is undigestable and it hurts a lot, and especially people who is having an agenda it hurts a lot! As always appreciate the work and sacrifices IV is doing for the immigrant community. Due to family and Work commitments could not involve actively.

    Even if we have five people agree to file this class action lets do it .....
    Once we have this law suit filled I'm sure will have the visiblity and whole band wagon will behind us.

    1, Let choose an attorney who understands our pain wants to fight for our cause. if its Rajiv Khanna so be it.

    2, Whatever the inital attorney consultion let split the consultation fee between five of us.

    3, Once we have a stream lined class action in place will gather more people.

    I absolutely agree what you said this will atleast help us to predict where we are with the processing ..If this whole thing is going to take 22 years tell us now..so we won't F****** throw away our life waiting for it.











    Lets file a lawsuit to get the info in a manner we need:


    1) breakdown of processing dates in a manner that co relates to visa bulletin.
    i.e.: tell us how many petitions by per country are pending/processed and processing dates by country and category. Atleast USCIS is answerable to visa bulletin.

    2) Visa usage by category reporting each month
    (How many petitions were approved are pending by visa category and by country) (here I mean just I140 and I485). Adjust the numbers if there are denials.

    This will atleast help everyone predict whats going to happen in recent months. One of the heartburns we have is no information comes out of USCIS and we are held hostage to what oppenheim says or Aytes says or Sheela Murthy says. This is public information so lets try and get it public every month.

    The other day you spent the entire day answering every question(s) people had. I even told my wife that our good friend is going to take all our worries out pretty soon. EB2 will no longer going accept porting so we will go faster and then guess what you didn't even file the law suit yet....you let us down!!

    I have a humble suggestion for you, please concentrate on your work and read some books on ethics and leave the GC processing to CIS.

    How can a person find out that you are there when you have not written a word after the first post. Now that you have replied, that is good. Everyone knows that you have read the responses.

    A kind request. Think about the question I am writing.
    What do you think we should be doing at this site? What is the objective of this site? Is everyone being part of that objective? What would be a constructive post to be a part of objective? What effort people have put toward the objective?


    Well, I am not annonymous and not ran away :). I read all the posts here and having a sense of "belonging". And the word "helpless" comes to mind.

    Did I say Nigerians should stand behind ALL of Chinese and Indians??? Can you read English? What I am saying is all should stand in line purely based on priority date, no matter whether he is Chinese, Indian, Japanese, or Nigerian. Yes, we were aware of the quota. yes, the quota has been there for a while. are you aware of robbery in this country? does that mean robbery is good? does that mean we should not do anything about that?

    You got to be kidding. Why not rename the "World" as "India" . Typical disdain. The quota was IN the system before anyone got here by H1B, so your argument is fallacious. We were all aware of the quota when we got here.

    There are highly skilled programmers from Nigeria also, just not in the same numbers. So you want them to stand behind all of China and India ?

    There are laws in place, already, for discrimination against applicant having proper work authorization.

    If the affected person does not report or take action, then nothing will happen. It is high time that "highly skilled workers" aware of their rights. Sanju mentioned a term "educated illiterates" for such reasons.

    Many consulting companies do not pay salary on bench. If the employee does not report to DoL, will he/she get his/her salary? No. The issue of discrimination is on the similar lines.

    There is no requirement for employer to consider any applicant who is on H-1B visa status. It is entirely voluntary and upto the employer whether to sponsor H1 visa or not. Same thing holds good for sponsoring green card as well.

    desi - the reason we face all these issues is not because of anyone's fault.
    Reporting an employer is not as easy as it sounds.
    The most educated and experienced people have always recommended to "protect yourself" - look for yourself and keep out of trouble.
    The issue here is - people in this situation are mere scapegoats - a common man who approaches beaucracy has to deal with crap that is worse.

    The entire process of immigrating to US via a employment based system is so loosely organized and puts people in unfair situations.

    It is just not desi employers or consulting companies, in general, but any employer can have an upper hand on you when you are at their mercy.

    People say big companies have policies and they abide. I agree, but it is not always the case. If someone is in business - they do things in their business interest - if dealing with USCIS is getting difficult - they may say "enough of it - no more responding to RFEs".

    One person contacted me - he is having a fulltime job and filed for AC21. he got RFE for EVL 2 times. The first time his HR gave EVL without any hasstles, the second time she was pissed, said "We do not want to deal with this - I have contacted legal and they recommend not to issue such letters".

    Now such a situation puts this person in a tough spot -the issue is not because of his employer because his employer did give a proper letter but USCIS asked it again.

    Just imagine what is this person's situation for no fault of his?

    We can always argue that "If you are worth and if company wants to retain you then they will not have any issues" - which once again may not always be true because we all know how relationships work out at companies - with ass kissing, nepotism, situations, financial etc......
