I did try to talk to customer care but it was of no help.
They tell me to wait for 30 days and sometime 60-90days.
They say you will become actual permanent resident when you get the card The card is important.
You now USCIS don’t know when they will change their minds.

To better be on safe side to get it stamped on my passport. I took info pass on 09-11-08 it will be almost 30 days,

    let’s wait and see

We need to define immediately available.

Now lets see how the above LAW (including immediately available) was followed in the following cases (which may not be a complete list).

    Oct 1 2005 & Oct 1 2006 when .27 = 140K = 37,800 GCs were available but ALL AOSs were not acceptable.
May 14 (??) when 60K GCs were available but many more AOSs were acceptable and were accepted from June 1-30.
June 12 when < 40K GCs were available but ALL AOSs were acceptable.
July 2 when 0 GCs were available and ANY AOS was not acceptable.
Months in 2005, 2006 and 2007 when ALL AOSs were not acceptable.
Months in 2005 and 2006 when ANY AOS was not acceptable.
10K+ GCs were returned in 2006 but soma (??) categories were not available.

in trouble. I am not on H1 but I think the moment you get H1, in this case COS from H4 to H1 within few months you should have paying job. There will be problem at time of extension if no paystubs are present. Bench or not employer need to Pay H1b if he has hired one.

I had infopass appointment this morning at Fairfax, VA regarding FP. IO told me that generally they send out FP within 30 days of 485 receipt but if ASC is too busy then it gets delay. He asked me whether my EAD and AP are approved or not. And then he requested FP for me and mywife and said i should receive FP notice within 3 weeks. Hopefully i will get FP within next couple of weeks. Keep you guys posted about my FP notice. Happy Holidays to you all !!

Last week I called USCIS regarding FP and Customer Representative told me that they have sent me a letter on 21st of Oct regarding SR I opened in the month of OCT (I haven't received that letter yet. Do not know where they sent it). I asked her about the content of the letter but she said she doesn't have that information and I have to wait till 19th Dec to open new SR. She suggested visiting local USCIS through Infopass. I have taken infopass appointment for this coming Friday. I will update you on Friday about the appointment.

We have been waiting for more than 100 days. We applied exactly 120 days before our current EAD was going to expire. When I called USCIS (after 90 days) , Customer Service told that that dont have our finger prints in file. I never got any notice and my lawyer said they dont need finger prints for paper filed application and they should use I485 finger prints. So I took the infopass appointment. IO was nice and he was willing to listen. He said the same thing (missing finger prints). I showed him the fingerprint receipts from last year and also showed the USCIS memo talking about interim EAD. He said no to interim EAD. But called Texas Service Center right then. Person on the other end offered to call back in 5 minutes and he did. IO came back and told us that there was some thing wrong at their end and they will port my finger print information from 485 to EAD application. But he said it would take 10 15 business days more. Our current EAD were expiring soon and I called congresswomans office next day. Got the approval email yesterday evening. Dont know what worked. But what a huge relief.

    EB-3-India (March 2003)
    Labor Approved: Oct 2006
    I-140 approved Jan 2007
    I-485 applied June 2007
EAD (Renewal) applied May first week 2008
Called USCIS and Opened SR August first week
Infopass at local uscis office: Aug 20th
Called Congress Womans office: Aug 21 st
    EAD Approval email: Aug 25

Does this mean, if someone has never done FP for 485, will need to do it now for EAD even if it is paper based?

I totally miss your point: why is ending retrogression bad? Because all 800K people might get the GC within 6 months? Whats wrong with that? Its not fair to those who have waited longer than others? Dont be a member of the "just because I suffered I want everyone else to suffer" That makes you no different from that talkshow host (who is now a citizen) on the radio channel recently who said he waited 10 years to get his GC, so everyone else also should, otherwise its not "fair"

Or, are you mixing up ending retrogression with making dates current? No thats not what we want. We want dates made current after the visa supply = demand. Just making all VBs like the July VB is pointless, and does lead to lots of uncertainties. By ending retrogression I mean making sure we have enough visa numbers for all who have been qualified by DOL (LC) and USCIS (I-140), by:
    - ending per-country quota
    - not counting dependents
    - recapturing wasted visa numbers.

I think we are talking about the same thing. If you see my post carefully, I clearly mentioned that I do not support lifting retrogression if the annual quota limit continues. I will be more than happy to see all quotas lifted and everyone gets GCs tomorrow. But I will not be happy if a 2007 person gets the GC tomorrow and I get mine after 5 years. That's exactly what might happen if they keep the quotas but remove retrogression

Really? Narendra Modi is great? And thats why he has been banned from visiting USA...WOW

    @buddyinsd

I did not know that visa to USA is also a certificate of good behavior. Does Modi needs a visa to USA to prove he is good or bad person or vice-versa ?

Well, every one had choice to be opinionated and I posted what I think think of Narendra Modi. Why, are people so crazy, that they start posting ( BS ) comments with red marks on post.

Not that I give damn about red color, but remarks and PM are unwanted.

I've started half fantasizing, half planning a better life outside the states. I think of everything in my life that could change for the better: more vacation, more travel, less of the neurotic american fear based mentality, more sun and summer, more time closer to my home country and relatives.

I plan to stay here for the long haul, since I've been with my american life partner for 8 years (no GC for gay couples, though!), own property here, etc. But it helps with alleviating feelings of depression to remind myself that I actually do have options in life, and that I am not just a victim of an unfair immigration system.

As far as ideas for mode of Re-imbursement,
it is quite simple and straightforward I think.

    1. Publish Aman's address,
    2. Instruct all pledgers to send cheques to his address made Payable to "Aman Kapoor".
    3. Publish a letter template, which states something to the effect "I am hereby sending a cheque for $xx to re-imburse Aman Kapoor for his expenses incurred while fighting for the rights of legal high-skilled immigrants. I am fully aware that this contribution is not intended to be used towards the Immigration Voice Non-Profit Fund and that it is specifically for re-imbursement of past expense incurred by Aman. I am fully aware that I am sending this amount of my own will out of gratitude towards him for fighting for my rights. I hereby also waive all my rights to request him to refund this amount or to file any litigation in this matter."
    4. All pledgers have to send this signed letter along with their cheque.

    Note:
    - i have not thought about tax consequences and we should not discuss that here as it is a personal matter, rather you can chat with Aman and fine tune this method.
    - it may be easier to set up a Administrative expense account within IV for this purpose as this may be ongoing affair, expenses incurred by core team is bound to keep going up in future.

    @desi3933:
On the other hand, I-140 is linked to Permanent Labor Certification (http://www.foreignlaborcert.doleta.gov/perm.cfm) (aka GC labor)

"Permanent Labor Certification" does not mean the job has to be "permanent" (you're again *assuming*, no?) It could also mean LC for "permanent" residency!

Looks like you missed this on that link:

The job opportunity must be for a full time, permanent position.

There must be a bona fide job opening available to U.S. workers.

Job requirements must adhere to what is customarily required for the occupation in the U.S. and may not be tailored to the foreign worker's qualifications. The employer must pay at least the prevailing wage for the occupation in the area of intended employment.

I got finger print notice on 6-16-07.
I never got receipt notice and I could not read the number in back of my check image. My attorney even did not get any receipt notice either:confused:

The finger print is scheduled for July 7th. I sent all app. to NCS on the June first and they transferred to TCS. PD of Sep 2003 and I-140 was approved 2005. I also apply for travel doc. and work permit but no receipt so far.

Did you see I said "legally speaking?" If our attorneys answered Yes to the question you mentioned, then according to you they all lied, since "no H-1B job is permanent!"

I-140 is for future GC and hence, must be full time and permanent.

I-140 is not for current H-1B job.

    You are mixing two things.

I think culture vs quality of life is a different thing.

I am not saying that one place is better than the other...

There are many things for which I love living in the US...long list...

there are many things for which I love living in India...I think the list might not be as long as the US one....

2 of the main things I miss in the US.
    1. Parents , Siblings and extended family....I do not know how much time anyone will have for me if I were to go back -:)
    2. Culuture...mainly for the kids...here once the kids are 10 or 11 I think you cannot tell them anything much...they have thier own mind and will not listen to you....and might end up making wrong decisions...again not saying that this is 100% safe in India...but agian in India I think the kids listen to you till they are a little older....this helps as they might be a little more mature by then and hopefully will make more wise decisions...

Again, I am not saying life is easier or better in one place compared to the other...

If I were to go back to India (which is what we plan to do in 2 years from now) then it will be becuase of the 2 main reasons above...I really wish there was a work around for the 2 above and I would then stay back -:)

Both are great countries with plus and minus....

    Peace !!!
All the best to all my friends here (the ones who stay and the ones who go back ) !!

Sanhari. I can very well understand the problems that you and every1 else face in EB3 category. But the way you are trying to put your case forward is wrong. By comparing with EB1 and EB2 priority dates you are just trying to show your frustration and not making a case at all. There is a reason they have different categories and similarly have priority dates for those. If you are eligible then port to EB2 else join IV with immigration reform or the latest fight to "Recieve EAD even if dates are not current". Please do not confuse teh congressmen or the senators who are already confused. Be proactive not jealous
