    I have mulled over different options in my head for a long time. Here are some things I came up with:

    - switch to a part time H1 (and do something else in your free time that you might find a little more fulfilling, i.e enrolling in PT grad program, starting a business (which you CAN do on an H1!!!), travel!!). I know there is the money factor but most of us are IT people and hopefully taking a cut will be worth the improved life.

    - begin your Canadian PR process. This takes a lot less time and honestly, I think Canadians are more cultured anyway. Leave these people to their Paris and Nicoles :)

    OK - I guess I didn;t come up with as many options as I had thought.... :)

    the Canada option and is not bad. you can get it in 1 year plus it will take less energy than it takes you now to remain depressed.

    Agreed it is the state dept not uscis.

    We should not mix the interpretation of eb2/3 visas with other immigrant visas including other eb due to perm.

    Could Please ask the lawyer this following question about statedept eb2/3 visa allocation to non-perm derivatives ?
    --
    * eb 2/3 generally require perm except for very rare cases. right ?
    The employer petitions for 1 permanent-employee. With assurance that the 1 person doesn’t displace local workforce (existing citizen and gc). How come state department allocates additional visa (more than approved) to derivative(s) who is not "perm labor certified" from a quota/poll (eb2/3) that mandates labor market test like perm ? (while the actual qualification is fb2a)

    * State department also burns the eb2/3 visa allocated for US-businesses to bring in much needed skilled eb2/3 labor ? while most real primaries wait, the visa gets allocated to non-productive derivatives ?

    Is state dept making mistake ?

    I spoke with our attorney
    He said
    INA Sec 203 talks only about the eligibility to apply the I-485. But the visa number is derived from a relationship to Principal applicant of green card. This is true for all categories Including investor, asylum, Employment categories. Please note that It is Dept of State that is responsible for this allocation not USCIS.

    I did cate 2 FP and received LUDs on I-765 and I-485 but when I received the EAD card, it said FP is not available. Based on that I assumed the FP was only I-485 related.

    Dear friends we are all in this long and arduous journey together! So let�s channelize and focus our energies to achieve our goals & not scoring goals / points over each other. Iam new to this forum. I see this as an excellent place to get information and hear different points of view. I highly respect comments / suggestions from other members, I know this journey has taken a toll on everybody, however cheer up and never loose hope, each one of us will have our day, persistence and hard work always pays, merit must rule and may it overrule !     What do you guys think about ROW EB3? Any chance for them folks or are they SOL as well?

    I am not sure what SOL stands for.
    But I can assure you that EB-3 ROW has very little hope. My estimate was that EB3-ROW's wait times were around 5-6 years.
    But now, I have a feeling, that its going to be more like 10+ years. And 10+ years is a long time. Some sort of reform will happen in the next five or six years, and even that reform is not likely to get us greencards, since it may emphasize the family-based applicants.

    Thats right. I don't see any issues with EB1 or EB2 movement, For gods sake EB2 came to 2005, EB1 is current. It is funny when the other poster said we need to work for EB1 also(It is current, what else you want to do there?).

    I feel IV has to concentrate on EB3 now. Period.

    It's simple. USCIS needs to understand it's just a plastic card and nothing else. People who have applied are going to be here no matter what.The return percentage is going to be less.

    The sad part is we are treated as citizens on all aspects. Social security, Medicare, Taxes, etc. etc. But not in the real sense. So US should realsise its after all a card and some benefits to the people things wont change. No amount of lobbying to fix the whole problem is going to help. The effort has to be concentrated just for EB3-Indians. Then we can expect some relief. Becasue we are talking about people who have been wwaiting for more than 8-10 years.

    In India Lifesentences in prisons dont last more than 14 years. we could beat that record here. :)

    If the Skil bill gets approved in the senate, when is it going to come to effect? Will the Cap increase for this year oct1 2006 to sept 31st 2007. And for the students who have already recieved their OPTs, will their OPT duration increase to 24 month? The bill for doubling of H1bs, is it the same as the SKil bill or a different one? when is that coming to effect?

    Hi friend,

    I understand your situation. You can do two things:

    1. Watch a recent documentary movie "The Secret" (you can rent it from Blockbuster and Netflix)

    2. Donate at least $100 to IV.

    Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...

    I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.

    SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.

    The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.

    Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

    Hi Gurus,

    I have couple of questions regarding my AC21 portability, please post your thoughts on this.

    My I485 was filed in July, 2007 based on approved I140 (EB3 India). Now I have new approved EB2 PERM labor from same company and I am also working for the same GC sponsor company and planning to interfile to my existing I485 so that I can capture old PD in to EB2. My question is,

    1) Can I invoke AC21 immediately after interfiling or do I need to wait another 6 months after interfiling?

    2) Will there be any impact on my old I485 application in case of interfiling denial?

    It is good to know that there are a few willing to do something about this!

    But we need more people!

    Even about 50 people is a good start! Come on people... spare a few minutes and take part in this protest!

    Don't go on with your lives as if nothing happened and don't think that nothing will happen!

    Most of us come from the land of Gandhiji... most of us have forgotten what that one little man achieved! But the fact is he couldn't have achieved everything that he did if the people of India didn't believe!

    So start to believe people! You can make a difference!

    Instead, lets "go postal" on USCIS
